General Terms and Conditions
Contract terms and legal information from subtel GmbH.
1 – Who we are and to whom these Terms apply
1.1 These Terms and Conditions ("Terms") govern all contracts concluded between subtel GmbH (Mainzer Str. 3, 10247 Berlin, Germany; "subtel" or "we") and you ("the Customer") via www.subtel.co.uk for the supply of goods to the United Kingdom.
1.2 A "consumer" is an individual acting wholly or mainly outside their trade, business, craft or profession (Consumer Rights Act 2015 s.2(3)). A "trader" is a person acting for purposes relating to their trade, business, craft or profession (CRA 2015 s.2(2)).
2 – Prices and payment
All prices are shown in GBP and include any applicable UK VAT. Delivery charges are shown separately during checkout. Payment methods accepted are listed during the order process.
3 – Order placement and contract formation
3.1 Product listings are an invitation to treat. By placing an order the Customer makes a binding offer.
3.2 Receipt of an order is acknowledged electronically; this acknowledgement does not constitute acceptance. The contract is formed when we dispatch the goods or send a separate confirmation of acceptance.
4 – Delivery
Delivery is made to addresses in the United Kingdom only. Risk in the goods passes to the Customer upon delivery (CRA 2015 s.29).
5 – Right to cancel (14-day statutory cancellation)
5.1 You have the right to cancel this contract within 14 days without giving any reason pursuant to the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. The cancellation period expires 14 days from the day on which you (or a third party other than the carrier indicated by you) acquire physical possession of the goods.
5.2 To exercise the right to cancel, inform us (subtel GmbH, Mainzer Str. 3, 10247 Berlin, Germany; email: info@subtel.co.uk) of your decision by a clear statement (e.g. a letter sent by post or email). You may use the model cancellation form provided as Schedule 3 Part B of the Regulations, but you are not obliged to.
5.3 Effects of cancellation: we will reimburse all payments received from you, including the costs of standard delivery, without undue delay and not later than 14 days from the day we are informed of your decision to cancel. We may withhold reimbursement until we have received the goods back. You must send the goods back to us without undue delay and in any event not later than 14 days from the day on which you communicate your cancellation. You will bear the direct cost of returning the goods.
5.4 Voluntary 30-day return. In addition to — and without prejudice to — your statutory 14-day right of cancellation, we voluntarily grant you an extended 30-day return period from receipt of the goods. The voluntary right is subject to the goods being unused and returned in their original packaging.
6 – Retention of title
Title to the goods remains with subtel GmbH until full payment of the purchase price has been received.
7 – Promotional vouchers
Vouchers issued in promotional campaigns are valid for a limited period and cannot be exchanged for cash. The applicable conditions accompany each voucher.
8 – Statutory rights (non-conformity / quality)
8.1 Under the Consumer Rights Act 2015 goods supplied by us must be of satisfactory quality (s.9), fit for purpose (s.10) and as described (s.11). Where they are not, you are entitled to the following statutory remedies:
- Tier 1 — 30-day short-term right to reject (s.22): reject the goods and obtain a full refund within 30 days of delivery.
- Tier 2 — Right to repair or replacement (s.23): require us to repair or replace the goods at no cost to you, within a reasonable time and without significant inconvenience.
- Tier 3 — Right to price reduction or final right to reject (s.24): after one failed attempt at repair/replacement, or where repair/replacement is impossible or disproportionate, claim a price reduction or reject the goods.
8.2 Voluntary 3-year warranty. In addition to and without prejudice to your statutory rights, we offer a voluntary 3-year warranty on all products. The detailed conditions are set out in our separate warranty terms.
8.3 Nothing in these Terms affects your statutory rights as a consumer.
9 – Limits of our liability
9.1 Nothing in these Terms excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) defective products under the Consumer Protection Act 1987; (d) any other liability that cannot be excluded or limited by English law (CRA 2015 s.65).
9.2 Subject to clause 9.1, our liability for breach of contract is limited to losses that were reasonably foreseeable at the time the contract was concluded.
9.3 Nothing in this clause affects your statutory rights.
10 – Governing law and jurisdiction
10.1 These Terms are governed by German law. Application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded.
10.2 If you are a consumer habitually resident in the United Kingdom, this choice of law does not deprive you of the protection afforded by mandatory provisions of UK consumer law — including the Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 and Part 2 of the Consumer Rights Act 2015 (unfair contract terms).
10.3 UK consumers may bring claims in the courts of their habitual residence.
11 – Alternative Dispute Resolution (ADR)
11.1 Pursuant to the Alternative Dispute Resolution for Consumer Disputes (Competent Authorities and Information) Regulations 2015, if your complaint has not been resolved by our internal complaints procedure you may refer the dispute to a Chartered Trading Standards Institute (CTSI) approved ADR provider:

11.2 subtel GmbH is not obliged to, and does not commit to, participate in alternative dispute resolution proceedings before a consumer arbitration body. We will, however, consider any such request on its merits.
12 – Waste Electrical and Electronic Equipment (WEEE) and waste batteries
12.1 Under the Waste Electrical and Electronic Equipment Regulations 2013 (SI 2013/3113) and the Waste Batteries and Accumulators Regulations 2009, electrical equipment and batteries must not be discarded with household waste. The crossed-out wheelie-bin symbol on the product indicates this.
12.2 You may return waste electrical equipment and waste portable batteries free of charge to a local civic amenity site (Designated Collection Facility) or, on a like-for-like basis, by post to subtel GmbH (please contact our customer service for the return address). subtel does not operate a formal Distributor Take-back Scheme but will accept returns of products it has supplied.
